Internet Usage Policy


Signal Peak Internet Usage Policies

To maintain in good standing and continue service with Signal Peak, customers (users) subscribing to Signal Peak's internet services are responsible for adhering to the following:

Non-acceptable uses include:
* Users must not restrict, inhibit or interfere with any other user's use of the services.

* Users must not provide Internet access or services to others via any means such as but not limited to: wireless routers, through dial-up connections, host shell accounts, e-mail services, news services or news feeds, FTP servers, HTTP servers, interactive forums, sending unsolicited bulk or commercial messages (SPAM), game servers or any peer to peer services or similar activities.

* Users may not resell, share or otherwise distribute services or any portion of them to sites outside of or off the premises of the installed equipment. IE, to other offices, neighbors, etc.

Signal Peak's Policy Concerning Peer to Peer (P2P) activities.
P2P enables users to join a "file sharing community", allowing them to search the network for files and to download those files to their own computers and share them with others.

Most P2P programs automatically make available or share files from the user's computer to other computers worldwide, unless, you, the user, takes action to prevent this. This means your computer is set up as a wide open server, without restrictions, open for anyone to access. Downloading and/or sharing copyrighted materials without a license can subject the user and Signal Peak to legal sanctions. In addition, the huge amount of traffic resulting from file sharing causes serious slowdowns for other users on the Signal Peak network.

Users are at risk personally if they use P2P applications to acquire copyrighted materials without buying or licensing those materials. In addition, computers are opened to the risk of viruses, worms, Trojans, password grabbers and general scumware. These are commonly attached to the files that are downloaded.

Federal law requires that Signal Peak take action when notified that someone on its network is distributing copyrighted materials. Signal Peak cannot protect clients who distribute copyrighted material without an appropriate license. If you are licensed, you must provide Signal Peak with a copy of the license. Since most P2P programs install themselves with worldwide sharing turned on by default and without notice to the user, it is very easy for their users to find themselves in serious trouble with the Law and with copyright holders, as well as having an infected, virus laden computer. The music and movie industry lawyers as well as software companies are aggressively pursuing and prosecuting violators.

If you are using P2P applications and are on Signal Peak's network, you should remove the P2P server application from your system.

If you continue to use P2P server applications, whether you are aware of the violation or not, your computer will be removed from the network until the violation is rectified. Additionally, legal action may be taken against you by the holder of the copyright for the material that was found on your system. Signal Peak is required to notify copyright holders and law enforcement agencies of any violations, actual or perceived.

Signal Peak Internet User Agreement
1. All equipment provided by Signal Peak for home or business use is and remains the property of Signal Peak.

2. Signal Peak reserves the right to deny service to anyone for any reason, at any time, without notice and without recourse by that person or business. If a customer infringes upon any Signal Peak policies, Signal Peak has the right to cancel their service without notice or warning and receive equipment back plus any unpaid bills within ten (10) days of the cancellation of their account. Failure to pay will result in account being turned over to a collection agency, thus incurring additional expense.

3. The customer is responsible for keeping the equipment in the condition in which it was issued. Signal Peak retains the sole right to make configurations to the equipment. Under no circumstance is the customer to reconfigure, reprogram, or otherwise tamper with the equipment provided.

4. The customer uses Signal Peak equipment at their own risk. Signal Peak is not responsible or liable for any damages that may occur to user's data, equipment, buildings or other facilities, including, but not limited to, damages from lightning or electrical surges, loss of business or for harm to any person(s) or damages resulting from the use of or during the installation of Signal Peak's equipment. User is responsible for making backups and keeping them up-to-date.

5. If service is canceled with Signal Peak for any reason, the customer must return all received equipment to the Signal Peak office in as-issued condition. See table of equipment costs.

6. The customer will maintain a working e-mail address with Signal Peak while a customer of Signal Peak, and will be responsible for paying invoices sent through e-mail to this address. If this e-mail address is changed, Signal Peak must be notified immediately of the change.

7. Invoices (monthly service bills) will be sent out at the beginning of each month for the month in advance. If the customer does not receive the invoice, it is his/her responsibility to contact the Signal Peak office. If the customer does not contact the office within ten (10) days, Signal Peak has the right to cancel service to that account and receive back any equipment and any balance due plus any fees.

8. If a customer's account does not remain in good standing with Signal Peak, due to nonpayment or equipment misuse, or for any other reason, Signal Peak has the right to cancel service and receive back all equipment provided plus any costs involved. Delinquency of forty-five (45) days or more by the customer can result in such cancellation, with the account being sent out for collections without further notice.

9. Customer's who have Signal Peak's equipment and/or service are responsible for paying monthly invoices. Issues preventing connection or intermittent connections as well as low connection speeds do not make the customer eligible for partial or nonpayment.

10. Signal Peak provides different levels of service, as outlined in the customer contract. The customer agrees to pay the appropriate monthly charge for the level of service they subscribe to. Signal Peak does not guarantee that customers will never go off-line nor that data speeds will not vary. Indicated data speeds are best effort, FTP burst speeds under ideal conditions. Signal Peak does not take any responsibility for lost business or income of the customer due to interruption or degradation of service. All services, including e-mail are provided on an as-is, as-available, no-recourse basis.

11. If the equipment becomes lost, stolen, or damaged, cosmetically or in functionality, due to misuse or negligence of the customer, the customer will be responsible for reimbursing Signal
Peak for the full replacement cost, including S/H charges, of said equipment. Equipment pricing schedule follows:

12. Signal Peak reserves the right to make changes or alterations to all user policies and service agreements, at any time, without notice. Policies are posted for customers to view at www.signalpeak.net.

Signal Peak Security and Privacy Policy
Fixed Wireless internet service is unlike a traditional dial-up Internet connection, in that the signals are broadcast over the air. It is remotely possible that they can be intercepted and decoded/decrypted. Signal Peak has taken steps to minimize illegal access. However, end users are warned that hackers and vandals could launch attacks against end user workstations. End users are responsible for the security of their workstations and should install antivirus software and either a hardware or software firewall. To be effective, the data that these programs use must be updated regularly, at least twice a week, but preferably more often. Products such as Norton Internet Security and similar products by McAfee, AVG, Avasti and others are available locally or as free downloads.

Signal Peak does not monitor or filter any Internet traffic except for email SPAM filtering/labeling, nor does it provide any kind of adult or other content screening. If content screening is needed, it is the responsibility of the end user to acquire such screening and configure it to their specific needs. We attempt to filter/label spam, but keep in mind that what is spam to you may be a critical "quality of life" enhancing item to your neighbor.

The major mail clients, such as Outlook Express and Thunderbird, have user configurable filtering built in. In Outlook Express, go to Tools ' Message Rules ' Mail ' New mail rule window. For Thunderbird, go to Tools'Message Filters'New' New mail rule window.

Rules typically are written as conditional statements: If subject contains______, then move message to _______. Example: If subject contains pills move message to Trash .

Generally speaking, it has proven impossible to keep up with the spam/scum purveyors. As fast as filters are developed and put in place, spammers develop new methods to get around them. It's a game of always trying to catch up.

Signal Peak does not make its customer data available to third parties except as required by law. We are required by federal law to provide data to certain governmental agencies on request, without a search warrant and without notification to customers.
